This agreement sets the specific terms for managed OpenCart hosting, server configuration, migration, backup and monitoring services provided by W3. It supplements the Service Agreement.
1. Service Description
W3 provisions cloud servers for the Customer’s OpenCart store or configures the Customer’s own server, and installs and manages the operating system, web server (Nginx), PHP-FPM, database, Redis, SSL, firewall, backup and monitoring components. Server resources (CPU, RAM, disk, traffic) are specified in the Quotation.
2. Setup, Migration and Fees
Setup, migration and ongoing engineering are billed hourly (USD 10/hour during the campaign). Third-party infrastructure costs such as servers, licenses and CDN are passed through at cost and invoiced monthly in advance. Migrations are rehearsed on a preview environment first; the DNS switch happens with the Customer’s approval.
3. Availability and Maintenance Windows
W3 targets 99.9% monthly availability for the server infrastructure. Planned maintenance is announced at least 24 hours in advance and scheduled in low-traffic hours where possible; planned maintenance is excluded from the availability calculation. For months below target, 10% of that month’s management fee (max. 50%) is credited upon request.
4. Backups and Data
Encrypted daily backups are stored off-site for 30 days and restore-tested monthly. Restores at the Customer’s request are billed hourly. Data belongs to the Customer; a full export is provided within 30 days of termination, after which data is securely deleted.
5. Security
W3 applies firewall, fail2ban, admin path protection, automatic SSL renewal, OS and PHP patches, and monitors security events. The Customer shall use strong passwords, restrict admin access to authorized persons and use licensed software. Clean-up of Customer-caused breaches is billed hourly.
6. Acceptable Use
Servers may only be used for the Customer’s e-commerce store and related systems. Unlawful content, spam, malware hosting, copyright infringement and attacks on third parties are prohibited; W3 may suspend service immediately in such cases.
7. Resource Overage
If traffic or resource usage persistently exceeds contractual limits, W3 informs the Customer and proposes a capacity increase. During sudden load spikes W3 may temporarily scale resources to keep the store available; costs are passed through after prior notice.
8. Term and Termination
Hosting renews monthly. Either party may terminate with at least 30 days’ written notice. Service may be suspended after 15 days of non-payment; after 30 days the server may be shut down with data backed up. W3 assists with migration on exit; there is no lock-in or exit fee.
9. Liability
W3 is not liable for third-party data-center outages, DDoS attacks, DNS/domain registration issues or configuration changes made by the Customer. Total liability is limited to the last 3 months of hosting and management fees.
