This form sets out the information that must be given to you before you confirm an order, as required by Turkish Consumer Protection Law no. 6502 and article 5 of the Distance Contracts Regulation, for service orders placed on OpencartExtra.com. An order cannot be completed before this form is read and approved; the version you approve is also e-mailed to you after payment, filled in with your order details.

1. Purpose, scope and retention of this form

This Pre-Contractual Information Form presents the mandatory information listed in article 5 of the Distance Contracts Regulation, in the order required by article 6 of the same Regulation, together with the details of your order. The form is an integral annex to the Distance Sales Agreement; the two documents are read together.

The scope of this form is the collection, by means of distance communication (through the website; by bank transfer/EFT and, where a credit card option is offered, through the relevant payment institution), of fees for services provided under the OpencartExtra.com brand. No physical goods are sold over the internet; the payment surface exists to collect service fees from customers we serve or have agreed to serve.

As required by article 11 of the Regulation, this form and the Distance Sales Agreement are sent to you on a durable medium — by e-mail, as PDF attachments filled in with your order details — once your order is completed. Both documents are also permanently available in the legal documents section at https://www.opencartextra.com, where you can read, print and store them.

The version of this form you approved is 1.1; your approval date and the IP address recorded at the moment of approval are set out in section 11 below.

2. Provider details and contact information (art. 5/1-b, c, ç)

You may use the e-mail address and telephone number above for complaints and requests; for correspondence about accounting, invoices and refunds you may also write to accounting@w3.net.tr. Our support channels operate Monday to Saturday, 09:00–22:00 (GMT+3); requests received by e-mail are answered within one business day at the latest.

No third party acts in the name or on behalf of the provider. Where a credit card option is offered, card payments are collected through the infrastructure of our payment service provider, PayTR Ödeme ve Elektronik Para Hizmetleri A.Ş.; PayTR is not a party to the contract but an intermediary for the payment transaction.

3. Essential characteristics of the service (art. 5/1-a)

The services covered by an order are technical services for OpenCart-based e-commerce stores: custom development and integration work, technical support, maintenance and optimisation, managed hosting, and the related domain name registration service. We do not sell off-the-shelf packages, themes or modules.

For hourly work (development, integration, bug fixing, optimisation) the nature of the service is defined in the quotation and the proforma document as sub-tasks, analysed effort and quoted effort. Quoted effort is the analysed effort plus an allowance for testing, deployment and handover.

For monthly packages (Support Basic/Priority/Dedicated, Maintenance Essential/Growth/Business) the nature of the service is the engineer hours included in the package, the response times and the routine maintenance items; the details are set out in the Support & Maintenance Service Level Agreement (SLA).

For managed hosting packages (Starter, Growth, Business) the nature of the service is a dedicated server installed, tuned and managed by us, together with the related backup, monitoring, SSL and mailbox services. The resource and feature differences between the packages are shown in the comparison table on the hosting service page and in the Hosting Purchase Terms document.

For the domain name registration service, the nature of the service is the registration of the .com or .net domain name you select, in your name, for the term you select, with an accredited registrar, carried out by our team.

The list of items included in your order, their quantity or term and their unit prices appear in the order summary in section 11 of this form.

4. Total price including taxes and how the price is calculated (art. 5/1-d, e, ı)

Our list prices are published in US dollars (USD), excluding VAT. Engineering time is USD 10 per hour for the duration of the launch campaign, managed hosting packages are USD 29 / 59 / 119 per month, an additional mailbox is USD 2 per month, and domain registration is USD 25 per year. The price of a monthly package is the number of hours it includes multiplied by the hourly rate.

Collection is made in Turkish lira. The amount set in USD is converted into Turkish lira at the time of the order using the foreign exchange selling rate of the Central Bank of the Republic of Türkiye; the rate applied, its date and its source are shown clearly in the order summary and frozen into the transaction record.

Value added tax at 20% is added to the total. The order summary shows the net amount, the VAT amount and the total including taxes separately; the amount charged on the payment screen is the total including taxes.

To protect you against exchange rate movements, the Turkish lira amount shown in the order summary is fixed for 30 minutes. If payment is not completed within that period the order is repriced and a new amount is shown at the current rate; no amount other than the one you approve is ever charged.

Because the services are performed electronically, no shipping, delivery or similar additional cost arises. No setup fee is charged and migration from your existing hosting provider is free of charge.

No charge above your ordinary tariff is requested for the distance communication tool (your internet connection) used to place the order.

No deposit, advance security, promissory note or other financial guarantee is required for an order.

The prices in this form relate to a single collection; no automatic recurring (subscription) charge is made, and where a card payment is made your card details are not stored. Continuation of a service after its term ends takes place through a new order or a new proforma.

5. Payment, performance and undertakings (art. 5/1-f)

Payment is taken by bank transfer/EFT: you pay to the account details shown on the proforma you approved, and the payment is confirmed by e-mail once it reaches our account. Please write the document number in the payment description.

Where a credit card option is offered, payment is taken in a single instalment through the 3D Secure enabled payment screen of our payment service provider, PayTR; instalment payments are not offered. Your card number, expiry date and security code never enter our systems at any stage and are never seen or stored by us.

Successful receipt of your payment is confirmed by e-mail without delay, once the notification from the payment institution has been verified. The confirmation e-mail contains your proforma document stamped PAID, together with copies of this Pre-Contractual Information Form and of the Distance Sales Agreement filled in with your order details.

For hourly work, performance begins once payment is confirmed and an engineer takes over the task; wherever possible the work is carried out on a staging copy of your store and submitted for your approval before handover.

For managed hosting orders, server installation starts after payment is confirmed; installation and delivery of the necessary access details are normally completed within one to three business days. Migration of your existing store is rehearsed first, and the final synchronisation and DNS switchover are performed at a low-traffic hour.

Domain registration is completed by our team with a registrar within one business day of payment being confirmed. Completion of the registration is notified by e-mail together with the domain name and its registration and expiry dates.

A business day means Monday to Saturday, excluding public holidays. Under article 16 of the Regulation, the period of performance never exceeds thirty days from the conclusion of the contract; if a service is not performed within that period you may terminate the contract and request a full refund of the amount you paid.

6. Right of withdrawal: conditions, period and procedure (art. 5/1-g)

Buyers who qualify as consumers have the right to withdraw from a service contract within fourteen (14) days from the date the contract is concluded, without giving any reason and without paying any penalty.

To exercise the right of withdrawal it is sufficient to send a clear and comprehensible withdrawal notice to the addresses set out in the following section before that period expires. The burden of proving that the notice was sent within the period lies with you, which is why we recommend giving notice by e-mail.

You may use the model form annexed to the Regulation for your withdrawal notice, but that form is not mandatory: any notice that clearly expresses your intention to withdraw is valid. Stating your order number (………) in the notice speeds up processing.

Once your withdrawal notice reaches us, the full amount collected is refunded within fourteen days at the latest, by the method used for payment: to the bank account the transfer came from, or, where a card payment was made, to the account linked to that card. The time it takes to appear in your account depends on your bank’s processing times; for card refunds it can typically take between two and twenty business days after we instruct the refund with the payment institution, and we have no influence over that period.

Refunds are never made by a method other than the one used for payment, and no cost is charged to you because of the withdrawal.

Subject to the exceptions in the next section, you may also exercise your right of withdrawal in respect of part of an order.

8. Cases in which the right of withdrawal cannot be exercised (art. 5/1-h and art. 15)

Under article 15 of the Distance Contracts Regulation, there is no right of withdrawal in the following cases, or the right ends together with the consent you have given. These cases arise frequently given the nature of the services we provide, so please read them carefully.

Art. 15/1-b — Contracts for goods prepared in line with the consumer's requests or personal needs: code, theme changes, integrations and similar bespoke work developed specifically for your store fall within this category.

Art. 15/1-ğ — Contracts for services performed instantaneously in an electronic environment, or for intangible goods delivered instantaneously to the consumer: completion of a domain registration with a registrar, allocation of a server and opening it for access, and similar operations fall within this category.

Art. 15/1-h — Contracts for services the performance of which the consumer has approved before the withdrawal period expires: if you tick the box in the order summary requesting that performance begin immediately, your right of withdrawal ends at the moment performance begins.

A domain registration becomes irreversible and non-refundable as soon as it is completed with the registrar, because the registration fee has been transferred to the registrar. Conversely, if for any reason the domain name you ordered cannot be registered in your name, the full amount you paid is refunded or, with your approval, an alternative domain name is registered.

For monthly packages and hosting, although your right of withdrawal ends once you approve the start of performance, you may cancel the service at any time before the next billing period; the cancellation and refund conditions are explained in detail in the Cancellation and Refund Policy.

Where performance has begun and the right of withdrawal is still available, the price of the part performed up to that moment is charged to you; that amount is calculated by multiplying the engineer hours spent by the hourly rate in the order and is notified to you on an itemised basis.

9. Digital content, technical protection measures and interoperability (art. 5/1-ı, i, j)

No copy protection, digital rights management (DRM) or similar technical protection measure restricting your use is applied to the source code, configuration files and reports delivered to you as part of our services.

Code is delivered so as to work with the OpenCart version and PHP version stated in the order. A later upgrade of the OpenCart core, of PHP, of the database server or of the third-party themes and extensions you use may affect operability; any adaptation required in that case is a separate piece of work.

Managed hosting is accessed over SFTP and through the management panel we provide; no third-party control panel such as cPanel or Plesk is offered. This choice is made in order to preserve the server configuration tuned for OpenCart.

The data hosted on our servers belongs to you; if the service ends you may request a full export within thirty days.

To complete the order process you need a current web browser, cookies and JavaScript enabled, and access to a telephone number for your bank's 3D Secure verification.

10. Complaints and dispute resolution (art. 5/1-k)

We ask that you first send any complaint concerning the order, payment, performance or refund process to hello@w3.net.tr. Your requests are logged and answered within one business day at the latest.

Buyers who qualify as consumers may bring disputes before the District/Provincial Consumer Arbitration Committees or the Consumer Courts of their place of residence or of the place where the transaction was carried out, within the monetary thresholds updated each year by the Ministry of Trade. The current thresholds and the application procedure are published on the Ministry of Trade's website.

Applications to Consumer Arbitration Committees may also be made electronically through the Ministry of Trade's Consumer Information System (TÜBİS).

For buyers who do not qualify as consumers (merchants or tradespeople), the Istanbul (Anadolu) Courts and Execution Offices have jurisdiction; provisions on mandatory mediation as a condition of action are reserved for such buyers.
